JOHN VINCENT ERICKSON [#52356], 68, of San Francisco was suspended for two years, stayed, placed on two years of probation and was ordered to prove his rehabilitation and take the MPRE. The order took effect Aug. 7, 2011.

Erickson stipulated to one count of misconduct stemming from a no contest plea to two misdemeanor counts of failing to file California income tax returns. Although he did not file returns for seven consecutive years, he paid estimated income tax which for three years exceeded the taxes he owed. By September 2009, Erickson paid the balance of all outstanding state taxes, penalties and interest.

His total tax liability was approximately $217,381 and he was ordered to pay a $5,000 fine to the Franchise Tax Board, $10,000 to the San Francisco District Attorney’s office and a $320 fine. He made full restitution and paid the fines.

There was no finding that his conduct involved any intent to defraud or act dishonestly nor did he intend to wilfully violate the law. Erickson stipulated that he failed to support the law.

He also failed to file federal income tax returns but resolved his problems with the IRS through it Voluntary Disclosure Program.

In mitigation, he cooperated with the bar’s investigation and with the district attorney, he is the sole provider for his developmentally disabled adult son, his wife died and he suffered emotional difficulties.
