August 28, 2016 JOSEPH DULLES ALLEN [#48922], 71, of Santa Barbara, was suspended from the practice of law for 60 days and placed on probation for two years. He must pass the MPRE. The order took effect Aug. 28, 2016. Allen stipulated that in one matter involving a personal injury claim he failed to file a civil action prior to the expiration of the statute of limitations, failed to file an opposition to a defense motion to stay or dismiss, failed to appear or send appearance counsel at a hearing and failed to file a first party insurance medical payment prior to the expiration of the statute of limitations. Allen also failed to render an appropriate accounting of the $6,000 in legal fees and costs advanced by a client.In another matter, involving a petition for dissolution and a receivership, Allen received court-ordered sanctions for failure to comply with rules and orders but did not pay some of them and did not report them to the State Bar.In aggravation, he caused significant harm to clients and to the administration of justice and committed multiple acts of misconduct. In mitigation, Allen has practiced for nearly 44 years without prior discipline, he admitted his wrongdoing and he provided evidence of his pro bono legal services for homeless people. |
