November 14, 2008 BARRY L. MORRIS [#48368], 62, of Walnut Creek was suspended for one year, stayed, placed on one year of probation and was ordered to take the MPRE within one year. The order took effect Nov. 14, 2008. Morris stipulated to three counts of misconduct committed while he represented a woman who was attempting to reduce her two-year driver’s license suspension to one year.Despite requests from the client’s husband for nearly a year, Morris never filed a writ. He eventually refunded her $2,500 advance fee. He stipulated that he failed to perform legal services competently, keep a client informed of developments in her case and he did not respond to a bar investigator’s inquiries. In mitigation, he had no discipline record in 35 years of practice. |
