MARC ALAN FISHER [#47794], 66, of Alameda was suspended for two years, stayed, placed on two years of probation with an actual 60-day suspension and he was ordered to take the MPRE within one year. The order took effect Feb. 11, 2011.

Fisher stipulated to four counts of misconduct in two loan modification matters.

A couple who owned seven properties hired Fisher to help them obtain mortgage refinancing and/or deeds in lieu of foreclosure on the properties. They paid a $7,000 advance fee, a $300 consulting fee and $2,100 for Fisher to hire a lender liability expert. He did no work and stipulated that he failed to perform legal services competently, refund unearned fees or deposit client funds in a trust account.

An attorney who was helping another couple who faced foreclosure gave Fisher $2,000 of his $10,000 fee to perform loan modification services. Fisher stipulated that he improperly split fees, without the clients’ consent, with a lawyer who is not a partner, associate or shareholder.

In mitigation, Fisher had no prior discipline record, he demonstrated remorse and cooperated with the bar’s investigation and he had medical problems at the time of the misconduct.
