May 30, 2001

MICHAEL J. BIGLOW [#47473], 56, of Fresno was disbarred May 30, 2001, and ordered to comply with rule 955 of the California Rules of Court.

Biglow was disbarred in a default proceeding after he failed to comply with rule 955 as ordered in a 2000 disciplinary matter. He had been disciplined five times in the past six years, all stemming from a 1994 case.

Biglow was ordered to file a rule 955 affidavit by July 5, 2000, but he did not; nor did he offer any explanation for his non-compliance.

Failure to comply with rule 955 is grounds for disbarment.

Biglow’s disciplinary history began when he was privately reproved in 1994 for failing to perform competently in one client matter. The next year, he was suspended for six months, stayed, and placed on probation for two years for failing to comply with conditions of his private reproval.

In 1997, the attorney received a three-month actual suspension for violating his probation. In 1998, he was given a six-month actual suspension for engaging in unauthorized practice of law during a suspension, among other violations. Last year, Biglow received a two-year actual suspension for violating probation.

In aggravation, the bar found that in failing to comply with rule 955, Biglow demonstrated indifference toward rectifying or atoning the prior misconduct. He also failed to participate in the disbarment prior to the entry of his default.

May 26, 2000

The probation of MICHAEL JUDSON BIGLOW [#47473], 55, of Fresno was revoked, the previous stay of suspension was lifted and he was actually suspended for two years and until he proves his rehabilitation. He was ordered to attend ethics school, take the MPRE and comply with rule 955. The order took effect May 26, 2000.

Biglow violated the terms of a 1998 disciplinary probation by failing to submit three quarterly probation reports or to provide evidence that he obtained psychiatric or psychological treatment at least twice a month.

The original discipline resulted from Biglow practicing law while suspended.

He has a record of three other disciplines. In 1994, he was privately reproved for failing to perform competently in one client matter. Because he failed to comply with the probation terms attached to the reproval, he was disciplined the following year. In 1997, the probation was extended and Biglow was suspended for again failing to comply with probation conditions from the earlier discipline.

Biglow “should not be permitted to remain on probation,” wrote bar court Judge Eugene Brott. “His noncompliance with his probation conditions demonstrates his inability or unwillingness to conform to the requirements of the law and raises concerns about the need to protect the public.”

Biglow did not participate in the disciplinary proceeding against him.

November 30, 1997

The previously ordered probation of MICHAEL JUDSON BIGLOW [#47473], 52, of Fresno was extended one year and his stay of suspension lifted, effective Nov. 30, 1997.

Biglow was actually suspended for three months and until he provides proof of passage of the MPRE, completion of the bar’s ethics school and completion of four hours of law office management courses. The actual suspension will not exceed six months and credit toward the period of actual suspension will be given for the period of involuntary inactive enrollment which began Aug. 7, 1997. He was ordered to comply with rule 955.

Biglow failed to submit timely probation reports, complete required MCLE hours, provide proof of passage of the professional responsibility exam and provide proof of completion of ethics school.

December 29, 1995

MICHAEL JUDSON BIGLOW [#47473], 50, of Fresno was suspended for six months, stayed, placed on probation for two years and ordered to take the CPRE within one year. The order took effect Dec. 29,1995.

Biglow was given a private reproval in 1994 and was ordered to attend ethics school, complete four hours of MCLE law office management courses and take the CPRE.

His failure to timely comply with those conditions led to the new suspension order.
