February 21, 2015 MICHAEL ALAN BRUSH [#46576], 75, of Sylmar, was suspended from the practice of law for six months and ordered to comply with rule 9.20 of the California Rules of Court. He was also placed on three years’ probation and faces a two-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect Feb. 21, 2014. Brush stipulated that between Aug. 2, 2013 and April 21, 2014, he commingled funds by using personal funds deposited in his client trust account to pay personal expenses. Brush had two prior records of discipline. In 2012, he received a public reproval following a conviction for driving under the influence with a blood alcohol level of .08 or higher. In 2014, he was disciplined for violating the terms of the earlier public reproval by failing to contact the Office of Probation by deadline to schedule a meeting, attend at least four meetings of an abstinence-based self-help group, declare under penalty of perjury that he had complied with all the conditions of his probation, arrange and pay restitution for any and all property damage caused by his misconduct or submit three quarterly reports to the Office of Probation by deadline. March 26, 2014 MICHAEL ALAN BRUSH [#46576], 74, of Los Angeles was suspended for one year, stayed, placed on three years’ probation with an actual 60-day suspension and ordered to take the MPRE and pay restitution. The order took effect March 26, 2014. Brush stipulated to failing to comply with the conditions of a 2012 reproval order. He failed to contact the Office of Probation by deadline to schedule a meeting, attend at least four meetings of an abstinence-based self-help group, declare under penalty of perjury that he had complied with all the conditions of his probation, arrange and pay restitution for any and all property damage caused by his misconduct or submit three quarterly reports to the Office of Probation by deadline. Brush was convicted in November 2011 of driving under the influence, a misdemeanor.Brush was ordered to pay $3,351.34 in restitution to the City of Los Angeles’ Department of Public Works.In mitigation, he entered into a pretrial stipulation with the State Bar. |
