July 28, 2005

RICHARD LAVERN WYRICK [#42504], 64, of Fresno was disbarred July 28, 2005, and was ordered to comply with rule 955 of the California Rules of Court.

In a default proceeding, the State Bar Court found that Wyrick failed to comply with probation conditions attached to his third disciplinary order — he failed to submit three probation reports, an account- ant’s certification about his handling of client funds, or proof of attendance at ethics school or trust accounting school. The court found that Wyrick willfully violated his duty to obey court orders and comply with probation conditions.

Wyrick’s disciplinary problems began with a public reproval in 1992 for using his client trust account for personal purposes. When he failed to comply with probation conditions attached to the reproval, he was disciplined again in 1994. In 2003, he was suspended and placed on probation for bouncing checks written against his client trust account. It was his failure to comply with probation conditions attached to that discipline that led to Wyrick’s disbarment.

In addition, he was placed on interim suspension in July 2004 following a conviction for eight counts of grand theft, and was disciplined again last March after he was convicted of child neglect. In addition, since 1992, he was suspended 11 times either for failure to pay bar dues or child support, he was placed on involuntary inactive status four times for presenting a danger to the public, and he was twice placed on administrative suspension for not complying with MCLE requirements or not passing the MPRE, as required in a disciplinary order.

At the time of the disbarment, Wyrick was incarcerated in Wasco State Prison.

July 7, 2004

RICHARD L. WYRICK [#42504], 63, of Fresno was placed on interim suspension July 7, 2004, following convictions for eight counts of grand theft. He was ordered to comply with rule 955.

April 17, 2003

RICHARD LAVERN WYRICK [#42504], 62, of Fresno was suspended for one year, stayed, placed on two years of probation with a six-month actual suspension and was ordered to take the MPRE within one year and comply with rule 955. The order took effect April 17, 2003.

Wyrick stipulated that he wrote at least 13 checks against insufficient funds in his client trust account and at least 20 personal checks against the account.

Wyrick has been disciplined twice.
