March 23, 2013

FADLO MOUSALAM [#38640], 73, of Castro Valley, was disbarred March 23, 2013, and was ordered to comply with rule 9.20 of the California Rules of Court.

Mousalam’s default was entered on Dec. 8, 2011 after numerous attempts to serve him with notices of disciplinary charges proved unsuccessful. The disciplinary proceeding against Mousalam resulted from his failure to comply with all of the terms of his disciplinary probation. Mousalam failed to participate either in person or through counsel and did not move to have the default set aside within 180 days and was disbarred under rule 5.85 of the bar’s Rules of Procedure. The charges are deemed admitted.

Mousalam has been disciplined two prior occasions. In September 2000, he received a 45-day actual suspension and two years probation for holding himself out to be entitled to practice law when he was enrolled as inactive. In September 2010, he was suspended for 60 days and was placed on probation for a year for failing to perform legal services with competence, promptly release all client papers, promptly respond to reasonable client status inquiries, promptly provide a client with an accounting, to return unearned fees, and to render appropriate accounts to his client.

FADLO MOUSALAM [#38640], 71, of Castro Valley was suspended for two years, stayed, placed on one year of probation with an actual 60-day suspension and he was ordered to take the MPRE within one year. The order took effect Oct. 15, 2010.

Mousalam stipulated to seven counts of misconduct in a divorce case in which he represented the wife. He and the client had ongoing differences of opinion about the matter, and he suggested twice that she find a new lawyer. When the client asked that he file a motion with the court to withdraw as her counsel, he did not respond for a week, and did not file a motion despite saying he would. He did no further work but remained her lawyer of record.

Almost two years later, Mousalam filed a motion to withdraw and provided an accounting of the client’s funds.

He stipulated that he failed to perform legal services competently, release a client file, respond to a client’s status inquiries or refund unearned fees.

In mitigation, Mousalam cooperated with the bar’s investigation. He was disciplined in 2000 for the unauthorized practice of law.

FADLO PAUL MOUSALAM [#38640], 61, of La Canada was suspended for one year, stayed, placed on two years of probation with an actual 45-day suspension and was ordered to take the MPRE within one year. The order took effect Oct. 15, 2000.

Mousalam practiced law while he was on inactive status, making court appearances on behalf of eight clients.

In mitigation, he has no record of discipline, no clients were harmed, he presented references to his good character and he cooperated with the bar’s investigation.
