ORION DOUGLAS MEMMOTT [#37600], 75, of Santa Cruz, was suspended from the practice of law for one year and was ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. He was also placed on two years’ probation and faces a two-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect Jan. 7, 2015. Memmott stipulated that he failed to abide by an Oct. 25, 2013 suspension order which required he comply with rule 9.20 by performing specified acts. The order stemmed from the fact that in August 2013, Memmott was convicted of two felonies – subscribing to a false tax document and attempted evasion of payment of tax. When Memmott first filed a declaration of compliance with rule 9.20, it was rejected because he failed to state when his clients and opposing counsel were notified of his suspension, what the notification stated, and whether the notification was sent by registered or certified mail, return receipt requested. Memmott then attempted, on three other occasions, to refile declarations of compliance, only to see them rejected due to other errors. In rejecting his fourth attempt, the Office of Probation noted the attachment to the 9.20 declaration was vague and listed the wrong date for when his suspension became effective and told him that he may not get another chance to file a corrected declaration. In mitigation, Memmott showed remorse, had no prior record of discipline and entered into a pretrial stipulation with the State Bar.
