April 17, 2011 THEODORE E. MILLARD [#36068], 72, of Reno was suspended for one year, stayed, placed on one year of probation with a 90-day actual suspension and was ordered to take the MPRE within one year and comply with rule 9.20 of the California Rules of Court. The order took effect April 17, 2011. In 2005, Millard was convicted of driving under the influence and causing bodily injury, a felony. He also entered into a settlement agreement for $1.1 million with an individual he injured while making a left-hand turn into a gas station. The court of appeal ordered Millard to make $175,000 in restitution to the victim and the bar placed him on interim suspension for almost two years.Millard stipulated that the conviction did not involve moral turpitude but did warrant further discipline and he failed to uphold California law.In mitigation, he had no prior discipline in 40 years of practice, cooperated with the bar’s investigation and presented evidence of his good character. |
