Discipline Summaries

November 9, 2007

MARGUERITE M. BUCKLEY [#33312], 75, of Torrance was suspended for six months, stayed, placed on one year of probation and was ordered to take the MPRE within one year. The order took effect Nov. 9, 2007.

Buckley stipulated to four counts of misconduct in representing a client in a forcible detainer action against a trailer park. Although Buckley filed a complaint and served the defendants, she did not file proof of service with the court on time, and missed three hearings and a case management conference. The case was dismissed, but Buckley did not notify her client or take any action to reinstate it.

She stipulated that she failed to perform legal services competently, respond to her client’s inquiries about the case or communicate with her client and she improperly withdrew from representation without taking steps to protect her client’s interests.

Buckley was privately reproved in 1998.

In mitigation, she cooperated with the bar’s investigation, demonstrated remorse, had medical problems and provided character reference letters.
