EARL CLIFFORD BROADY JR. [#33307], 78, of Los Angeles was suspended for two years, stayed, placed on three years of probation with a one-year actual suspension and he was ordered to comply with rule 9.20 and prove his rehabilitation. The order took effect Dec. 6, 2008.

Broady stipulated to misconduct in two matters. In a criminal matter, he did not refund his client’s unearned fees promptly or account for the funds. The client believed she was facing felony charges and paid Broady a $2,500 advanced fee. However, the matter was referred to the city attorney’s office as a misdemeanor and charges were never filed.

Despite his client’s repeated requests, Broady never accounted for the fee and did not provide a refund for almost two years.

He also stipulated that he commingled personal and client funds in his client trust account and wrote a check against insufficient funds.

Broady was disciplined in 1992 for failing to perform legal services competently and in 2005 for committing acts of moral turpitude by writing checks against insufficient funds. He also commingled funds in his trust account.

In mitigation, he presented references to his good character.

EARL C. BROADY JR. [#33307], 74, of Inglewood was suspended for two years, stayed, placed on two years of probation and was ordered to take the MPRE within one year. The order took effect April 23, 2005.

Broady stipulated that he used his client trust account to pay personal and business expenses and wrote checks against insufficient funds in the account, committing acts of moral turpitude. In addition, he admitted he placed personal funds in the account in order to hide the money from his estranged wife, actions that constituted moral turpitude.

Broady was disciplined in 1992 for failing to perform legal services competently.
