JOHN PASQUALE BRUNO [#32822], 69, of West Hills was disbarred May 13, 2007, and was ordered to comply with rule 9.20 of the California Rules of Court.

In a default proceeding, the State Bar Court found that Bruno did not comply with rule 9.20, as ordered in a 2005 discipline. He failed to file with the court an affidavit attesting that he notified his clients, courts and other pertinent parties of his suspension from practice.

He has a record of three prior disciplines. In the underlying matter, also a default proceeding, the bar court found in 2006 that Bruno committed seven acts of misconduct in two matters. He failed to perform legal services competently, communicate with a client, return client papers, refund unearned fees or cooperate with the bar’s investigation and he improperly withdrew from representation.

He also was disciplined twice in 1994 for misconduct somewhat similar to the 2006 discipline.

In recommending disbarment, Judge Pat McElroy wrote, Riggs “has demonstrated an unwillingness to comply with the professional obligations and rules of court imposed on California attorneys although he has been given opportunities to do so. . . It would undermine the integrity of the discipline system and damage public confidence in the legal profession if (he) were not disbarred for his willful disobedience of the Supreme Court order.”

JOHN PASQUALE BRUNO [#32822], 67, of West Hills was suspended for three years, stayed, actually suspended for two years and until he makes restitution, the State Bar Court grants a motion to terminate the suspension and he proves his rehabilitation, and he was ordered to take the MPRE and comply with rule 955. The order took effect Jan 27, 2006.

In a default proceeding, the bar court found that Bruno committed seven acts of misconduct in two matters.

He did not cooperate with the bar’s investigation of a matter in which he represented the plaintiffs, but the court dismissed a charge that he violated a court order.

In the second matter, he represented a client who purchased a HUD property that the city later found to be uninhabitable. The client asked Bruno to obtain a refund of his deposit or to “recooperate” the home. Bruno wrote two letters explaining why the client was not making his mortgage payments and wrote to HUD, the mortgage holder and the sellers demanding that the client’s $10,000 deposit be returned. He then did no further work, effectively withdrawing from the case. He did not respond to several letters, return the client’s file or refund any fees.

The bar court found that he failed to perform legal services competently, communicate with a client, return client papers, refund unearned fees or cooperate with the bar’s investigation and he improperly withdrew from representation.

Bruno has been disciplined twice previously, both times in 1994, for misconduct somewhat similar to the new matter.
