February 22, 1997 The probation of GERALD J. TIERNAN [#30303], 64, of San Francisco was revoked and the previously stayed suspension was lifted Feb. 22, 1997. He was actually suspended for 11 months, placed on four years of probation, and ordered to comply with rule 955. The State Bar Court review department found that Tiernan did not cooperate with his probation monitor and twice failed to file probation reports on time. He was given a one-year stayed suspension and placed on three years of probation in 1993 for improperly using his client trust account for personal banking and for writing three bad checks on the account. When he did not file his first three probation reports on time, the probation was extended for a year. Tiernan then filed two subsequent quarterly reports late. The hearing judge recommended that his probation be revoked and that he be given an actual six-month suspension. Tiernan appealed to the review department, which rejected his arguments and increased his discipline. The review department noted Tiernan also was disciplined in 1990, when he was publicly reproved for abandoning clients; in 1994 for violating probation by failing to file three quarterly reports on time; and in 1995 for failing to communicate with two clients and perform legal services competently. |
