Muller’s default was entered when he failed to respond to a notice of disciplinary charges. Because he made no effort to vacate the default within 180 days, he was disbarred under rule 5.85 of the State Bar’s Rules of Procedure and the charges were deemed admitted.Muller failed to promptly refund unearned fees, engaged in acts constituting moral turpitude by telling a client he’d filed a notice of intent with the U.S. Citizenship and Immigration Services on behalf of the client’s minor son when he hadn’t and failed to cooperate in a State Bar investigation.He was ordered to pay $1,250 plus interest in restitution. |
