JOHN VARGAS [#270181], 46, of Riverside, was disbarred Oct. 23, 2015 and ordered to comply with rule 9.20 of the California Rules of Court.

Vargas was disbarred after his default was entered for failing to appear at trial on 27 counts of misconduct. He made no effort to have the default set aside or vacated within 45 days as required under rule 5.85 of the State Bar’s Rules of Procedure, he was disbarred and the charges against him deemed admitted.

Vargas engaged in misconduct in six matters, including: failing to perform legal services with competence (four counts); failing to respond to a client’s reasonable status inquiries (four counts); improper withdrawal from employment; failing to cooperate with the State Bar in a disciplinary investigation; failing to take steps to avoid reasonably foreseeable prejudice to a client (three counts); failing to return client papers and property; failure to pay funds to a client; failing to comply with three court orders; failing to report judicial sanctions (two counts); failing to provide a substantive response to a State Bar investigator’s letters (five counts); aiding in the unauthorized practice of law; and sharing fees with a non-lawyer.

Vargas had one prior record of discipline, a 2014 suspension for failing to obey a court order to pay sanctions, cooperate with the State Bar, properly withdraw from employment or perform services competently.
