JESSICA ELAINE RAUFF [#262264], 30, of San Jose, was disbarred Sept. 6, 2013 and ordered to comply with rule 9.20 of the California Rules of Court and pay restitution.

Rauff was disbarred after her default was entered when she failed to file a response to the notice of disciplinary charges filed against her. Under rule 5.85 of the California Rules of Procedure, an attorney can be disbarred if he or she does not move to have the default set aside with 180 days.

The charges were deemed admitted: Rauff failed to perform legal services with competence, unlawfully collected upfront fees for loan modification services and charged and collected an illegal fee. She also failed to respond to reasonable client inquiries, notify a client of a significant development in her case or to promptly return unearned fees. Rauff was ordered to pay $1,000 plus interest in restitution.
