Discipline Summaries

July 19, 2015

RICHARD SCOTT DESAULLES [#255419], 42, of Pago Pago, American Samoa, was suspended from the practice of law for 30 days and ordered to take the MPRE. He was also placed on two years’ probation and faces a two-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect July 19, 2015.

DeSaulles stipulated to misconduct in two matters. In one matter, deSaulles failed to pay sanctions of $20,728.53 for more than two years, did not report the sanctions to the State Bar and failed to supervise his private investigators after instructing them to interview jurors, leading them to provide misleading information to the jurors.

In the other matter, deSaulles constructively terminated employment with a client without notifying him, failed to respond to the client’s requests for status updates on his personal injury matter and failed to inform the State Bar of a change in his membership address.

In mitigation, he entered into a pretrial stipulation with the State Bar.
