LEE SIK NO [#249092], 36, of Newport Beach, was disbarred April 18, 2015 and ordered to comply with rule 9.20 of the California Rules of Court.

No was disbarred after his default was entered for failing to respond to a notice of disciplinary charges against him. Because he did not seek to have the default set aside or vacated within 180 days as required under rule 5.85 of the State Bar’s Rules of Procedure, the State Bar moved to disbar him.

The charges against him were deemed admitted. In one matter, No failed to perform legal services with competence by filing a lawsuit for a client then not performing any other services of value for him, improperly withdrawing from employment and not promptly responding to approximately 60 phone calls from the client. In addition, he did not respond to two letters from a State Bar investigator looking into the allegations against him and did not comply with a sanctions order against him.

In another matter, No failed to comply with conditions of his disciplinary probation by not submitting three quarterly reports on time and failing to submit proof of restitution payments owed to four parties by deadline, pay any installment restitution payments by deadline or attend Ethics School as ordered.

No had two prior records of discipline. In August 2012, he was suspended after stipulating to misconduct in nine loan modification matters that included not refunding unearned fees to his client and accepting advanced fees for loan modification work before the work was completed, in violation of state law. In October 2013, he was suspended for misconduct in three matters including charging advanced fees for home loan modification services, making a false statement to a client and failing to perform legal services with competence. He also did not respond promptly to a client’s reasonable status inquiries about her case, return an unearned advanced fee, cooperate with a disciplinary investigation, keep a client reasonably informed or file a declaration of compliance with rule 9.20 as required by an earlier discipline matter.

LEE SIK NO [#249092], 34, of Newport Beach was suspended for two years, stayed, placed on three years’ probation with an actual six-month suspension and ordered to take the MPRE, comply with rule 9.20 of the California Rules of Court and pay restitution. The order took effect Oct. 26, 2013.

No stipulated to misconduct in three matters including charging advanced fees for home loan modification services, making a false statement to a client and failing to perform legal services with competence, respond promptly to a client’s reasonable status inquiries about her case, return an unearned advanced fee, cooperate with a disciplinary investigation, keep a client reasonably informed, or file a declaration of compliance with rule 9.20 as required by an earlier discipline matter.

In one matter, No illegally charged a client upfront fees even though he had not performed all of the loan modification services she had hired him to do and did not work on a bankruptcy matter she had hired him to handle, despite the fact that she had paid him $4,274. He was ordered to pay $8,758.50 plus interest in restitution.

In mitigation, No entered into a pre-trial stipulation, saving the State Bar time and resources.

No was previously suspended in 2012 for charging and collecting an advanced fee for home mortgage loan modification services and failing to return illegal, unearned fees in four matters. No also failed to notify the State Bar of his change of address within 30 days.

LEE SIK NO, 33, of Newport Beach was suspended for one year, stayed, placed on two years of probation with a 90-day actual suspension and he was ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. The order took effect Aug. 18, 2012.

No stipulated to nine counts of misconduct in nine loan modification matters. In each matter, he did not refund unearned fees to his client and by accepting advance fees for loan modification work before the work was completed, he violated state law.
