SCOTT MONTGOMERY CURREY [#242320], 43, of Dixon, was disbarred Oct. 11, 2015 and ordered to comply with rule 9.20 of the California Rules of Court.

Currey was disbarred after his default was entered when he failed to file a response to a notice of disciplinary charges against him. Because he did not seek to have the default set aside or vacated within 90 days as required under rule 5.85 of the State Bar’s Rules of Procedure, he was disbarred and the charges against him deemed admitted.

Currey failed to comply with the terms of his probation resulting from a 2012 private reproval.

Currey had two prior records of discipline. The 2012 private reproval was for failing to perform services competently, communicate with a client or return unearned fees in a single client matter. In 2014, he was suspended for failing to comply with the conditions of his earlier private reproval.

SCOTT MONTGOMERY CURREY [#242320], 41, of Dixon was suspended for two years, stayed, placed on two years’ probation with an actual 30-day suspension and ordered to take the MPRE. The order took effect April 23, 2014.

Currey stipulated that he failed to comply with the terms of a 2012 private reproval. He did not submit one quarterly report to probation and failed to make multiple monthly restitution payments, make another restitution payment on time, submit proof of restitution payments to the Office of Probation on time or submit proof of other restitution payments altogether.

Currey’s 2012 private reproval was for failure to perform with competence, refund unearned fees or communicate.
