July 18, 2013 EVAN A. NIELSEN [#239691], 52, of Chandler, Ariz., was suspended for one year, stayed, placed on one year of probation with an actual 30-day suspension and ordered to take the MPRE. The order took effect July 18, 2013. Nielsen stipulated to practicing law in Arizona, where he is not a member of the bar, and to collecting an illegal fee.According to the stipulation, Nielsen agreed to represent a woman in a civil matter regarding a horse trailer which was located in Arizona and in the possession of an Arizona resident. Nielsen signed a fee agreement with the woman, collected $750 from her to begin work on her case and negotiated with the man who had her trailer, despite not being entitled to practice law there. Nielsen had received two prior warnings for similar conduct in Arizona.In mitigation, numerous lawyers and business owners attested to Nielsen’s good character, and he has a long record of civic service and charitable work. He also entered into a stipulation with the State Bar prior to the formal filing of disciplinary charges. |
