Discipline Summaries

March 14, 2008

MICHAEL ALAN GIULIANTI [#237078], 37, of Hollywood, Fla. was summarily disbarred March 14, 2008, and was ordered to comply with rule 9.20 of the California Rules of Court.

In 2006, Giulianti pleaded no contest to “uttering a forged instrument” (passing a counterfeit note) in Florida, a third-degree felony. When the State Bar recommended his summary disbarment, Giulianti argued that the crime was a wobbler that could have been charged as a misdemeanor in California and he said the conviction was not final because the sentence was suspended.

The State Bar Court review department rejected both claims and noted that the time for appeal has expired.

Because the offense is a felony that involves moral turpitude, it meets the requirements for summary disbarment.
