KLAYTON KHISHAVEH [#236903], 49, of Rancho Margarita, was suspended from the practice of law for two years and ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. He was also placed on four years’ probation and faces a three-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect July 22, 2015.

Khishaveh stipulated to misconduct in three client matters: committing acts involving moral turpitude, failing to maintain his client’s funds in trust, failing to pay client funds promptly, misappropriation and commingling personal funds in his client trust account. In addition, he issued checks from his client trust account when there were insufficient funds to cover them, disobeyed a court order and failed to report judicial sanctions to the State Bar.

In one of the matters he was disciplined for, Khishaveh falsely asserted to his client’s doctor who was owed money that his client’s case had settled for less that it had. He also proposed a three-way split and requested she lower the amount of her lien. He also failed to maintain a balance of $2,789 on behalf of the doctor in his client trust account, misappropriating the money.

In mitigation, he had no prior record of discipline and entered into a pretrial stipulation with the State Bar.
