ALDON LOUIS BOLANOS [#233915], 37, of Sacramento, was suspended from the practice of law for 90 days and ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. He was also placed on one year of probation and faces a one-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect Nov. 27, 2015.

A State Bar Court hearing judge recommended a 90-day suspension but the Office of Chief Trial Counsel appealed, arguing that Bolanos was culpable of moral turpitude by intentional misappropriation. A three-judge review panel affirmed the hearing judge’s finding of no moral turpitude.

Bolanos’ misconduct involved one client matter. He failed to advise a client that she might want different counsel from a co-plaintiff in a suit against their employer R.J. Reynolds Tobacco Company when the plaintiffs’ interests potentially conflicted. He also failed to promptly notify the client he had received a settlement check, and then removed $61,775.50 in disputed funds from his client trust account. He also failed to promptly release the client’s file when she fired him.

In mitigation, Bolanos entered into a stipulation with the State Bar, presented 14 strong character witnesses and showed remorse and recognition of his wrongdoing.
