July 19, 2015 NICOLE ROSIE GALLEGOS [#231744], 39, of Irvine, was disbarred July 19, 2015 and ordered to comply with rule 9.20 of the California Rules of Court. Gallegos failed to respond to a notice of disciplinary charges alleging she engaged in the unauthorized practice of law in another jurisdiction, charged an illegal fee, charged an upfront fee for loan modification services, aided in the unauthorized practice of law and failed to cooperate in a State Bar investigation, provide her client with the proper notice, respond to client status inquiries and perform legal services with competence. Because she did not to seek to have the default set aside within 180 days, the State Bar moved to disbar her under rule 5.85 of its Rules of Procedure.Gallegos had one prior record of discipline, a 2013 suspension for six counts of collecting illegal fees from out-of-state clients and multiple counts of engaging in the unauthorized practice of law.April 6, 2013 NICOLE ROSIE GALLEGOS [#231744], 36, of Irvine, was suspended for two years, stayed, and placed on two years of probation with an actual nine-month suspension that will continue until she pays restitution. She was also ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. The order took effect April 6, 2013. Gallegos stipulated to 15 counts of misconduct in seven loan modification matters, six of which involved collecting illegal fees from out-of –state clients. Gallegos also committed multiple counts of unauthorized practice of law. She has been ordered to pay $ 11,979.98 in restitution.In mitigation, Gallegos acknowledged her wrongdoing and entered into a pre-trial stipulation. |
