August 28, 2016 ELIAS FRANCISCO PORTALES [#230402], 39, of Fremont, was suspended from the practice of law for 90 days and placed on probation for one year. He must pass the MPRE. The order took effect Aug. 28, 2016. Portales stipulated that he accepted a fee in a debt collection matter for a client but failed to obtain the client’s consent to the payment of the fee by a third party. He failed to file a response to the complaint, oppose a motion for entry of default and properly file a motion to set aside default. He failed to refund the unearned fees of $3,000. That amounted to a failure to perform legal services with competence.In another matter, Portales failed to keep a client informed regarding her claim against Bank of America or promptly refund a $1,500 fee. In aggravation, Portales had a prior record of discipline and committed multiple acts of misconduct. In mitigation, he acknowledged his misconduct.July 6, 2008 ELIAS F. PORTALES [#230402], 31, of San Francisco was suspended for 18 months, stayed, placed on three years of probation and was ordered to take the MPRE within one year. The order took effect July 6, 2008. Portales stipulated to four acts of misconduct in a dissolution proceeding. He did not file the dissolution or inform his client. He left his office and began working for a new firm; the client was unable to reach him although he received her messages.She fired him and asked for her file via e-mail at his new office, but he did not return her file or refund unearned fees. He later said he was open to resolving her complaints, but although the client responded to his e-mail 37 minutes later, she did not hear from him again. He eventually refunded the unearned fees seven months later.Portales stipulated that he failed to perform legal services competently, keep a client informed about developments in her case, communicate with a client or promptly refund unearned fees. |
