ZHEN XIANG WANG [#229114], 51, of Fengai, China, was disbarred Oct. 30, 2014 and ordered to comply with rule 9.20 of the California Rules of Court.

Wang was disbarred after his default was entered for failing to respond to charges that he failed to comply with rule 9.20 as required by a 2011 disciplinary order. Because he did not seek to have the default set aside within 180 days as required by rule 5.85 of the State Bar’s Rules of Procedure, he was disbarred and the charges against him were deemed admitted.

Wang was previously suspended for misconduct in two matters, including failing to perform legal services competently or cooperate with the bar’s investigation. He also committed acts of moral turpitude by making misrepresentations to the court.

ZHEN XIANG WANG, 48, of Fenghai, China, was suspended for 18 months, stayed, actually suspended for 90 days and until the State Bar Court grants a motion to terminate the suspension, and ordered to take the MPRE within one year and comply with rule 9.20 of the California Rules of Court. If the actual suspension exceeds two years, he must prove his rehabilitation. The order took effect Sept. 30, 2011.

In a default proceeding, the bar court found that Wang committed four acts of misconduct in two matters, including failures to perform legal services competently or cooperate with the bar’s investigation, and he committed acts of moral turpitude by making misrepresentations to the court.

While representing a client in an immigration matter, Wang submitted an immigrant petition with, as supporting evidence, research papers the client did not author. The client had submitted his own research, but Wang used another client’s research in the petition. The petition was denied, and a subsequent appeal also was denied on the grounds that it included false information. The court also said it intended to issue a finding of fraud and willful misrepresentations on the part of the client.

A new lawyer alleged that Wang physically altered the documents, but Wang did not respond to the allegations. The court denied the client’s petition, saying it could not make a fair assessment without a response from Wang. It also issued a fraud finding against the client. That finding eventually was reversed, the client was cleared and the bar opened an investigation of Wang.

While investigating a complaint from another client, the bar found that Wang did not keep his address current with membership records.
