ASHKAN ALEX MOTAMEDI [#228384], 46, of Laguna Hills, was disbarred Aug. 23, 2013 and ordered to comply with Rule 9.20 of the California Rules of Court.

Motamedi was found culpable of failing to comply with rule 9.20, required as the result of a 2012 disciplinary order.

Motamedi has two prior records of discipline. In 2013, he was suspended for failing to respond to client inquiries or perform with competence and improperly withdrawing from a personal injury case in which he was representing the plaintiffs. In 2012, he was suspended for committing five acts of misconduct in a single matter: failing to perform legal services competently, account for client funds or to cooperate with the bar’s investigation or obey a court order. He also improperly withdrew from employment.

Motamedi failed to respond to client inquiries, failed to perform with competence, and improperly withdrew from a personal injury case in which he was representing the plaintiffs. Motamedi has been disciplined on one prior occasion. In 2012, he was suspended for 18 months, stayed, and placed on probation for three years with an actual 90-day suspension for five acts of misconduct in a single matter: he failed to perform legal services competently, account for client funds, cooperate with the bar’s investigation or obey a court order, and he improperly withdrew from employment.

ASHKAN ALEX MOTAMEDI, 45, of Laguna Hills was suspended for 18 months, stayed, placed on three years of probation with an actual 90-day suspension and until he proves his rehabilitation, and he was ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. The order took effect June 17, 2012.

The State Bar Court found that Motamedi committed five acts of misconduct in a single matter: he failed to perform legal services competently, account for client funds, cooperate with the bar’s investigation or obey a court order and he improperly withdrew from employment. He abandoned the case and allowed it to be dismissed.

Motamedi represented a client who alleged that a travel agent had stolen her identity and signed her name to a real estate purchase agreement. He was sanctioned twice after being two hours late to a deposition and missing a status conference. He didn’t pay either sanction. At some point he stopped working on the case but took no steps to avoid dismissal. The client advanced $3,500 to hire an expert, but he did not do so and did not account for the funds.

The client was forced to hire a new attorney but was unable to avoid dismissal of her case and was subject to a judgment for costs awarded to the other side.

In mitigation, Motamedi had no prior discipline record.
