Discipline Summaries

June 6, 2015

RAYMOND FAULKNER CHOI [#227132], 38, of Puyallup, Wash., was suspended from the practice of law for two years and ordered to comply with rule 9.20 of the California Rules of Court. He was also placed on three years’ probation and faces a three-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect June 6, 2015. In one matter, Choi failed to file a rule 9.20 compliance affidavit as required by an earlier disciplinary order. He also failed to meet with his probation deputy and did not submit two quarterly reports to probation on time as required by his disciplinary probation. Choi had one prior record of discipline, a 2014 suspension for willful disobedience of a court order to pay sanctions, failing to appear for hearings, notify the client and the court of nonappearance or keep all agreements made in lieu of disciplinary prosecution and intentional reckless or repeated failure to perform legal services with competence.

RAYMOND FAULKNER CHOI [#227132], 36, of Huntington Beach was suspended for two years, stayed, placed on two years’ probation with an actual 90-day suspension and ordered to comply with rule 9.20 of the California Rules of Court. The order took effect March 26, 2014.

Choi stipulated that he committed misconduct in three client matters: willfully disobeying a court order and failing to perform legal services with competence or to keep all agreements made in lieu of disciplinary prosecution.

In one matter, in 2009, Choi failed to show up for pretrial hearings in his client’s criminal matter and did not inform the client or the court that he would not be attending. In another, in 2010, Choi asked to be relieved from representation of a client who had not paid him. Despite the judge’s order to remain counsel of record for his client until a new attorney appeared on her behalf and to return for an upcoming pretrial appearance, Choi called the court that morning saying he could not attend. As a result, the judge issued a bench warrant hold. At a later appearance, Choi appeared before the court to apologize for his actions. As of the date of his stipulation, however, he had not paid $1,000 in sanctions imposed by the judge.

In 2011, Choi entered into an agreement in lieu of discipline for his previous acts of misconduct in the two clients’ cases and then committed additional misconduct. He failed to appear at both the June 1, 2012 pretrial conference and the June 6, 2012 trial in a client’s criminal matter.

In mitigation, Choi had no prior discipline and entered into a prefiling stipulation with the State Bar.
