November 3, 2011 THOMAS SCOTT SIMONS, 44, of Plano, Texas, was suspended for three years, stayed, placed on four years of probation with a two-year actual suspension and until he proves his rehabilitation and he was ordered to comply with rule 9.20 of the California Rules of Court. The order took effect Nov. 3, 2011. Simons stipulated that he failed to comply with a rule 9.20 requirement that was part of a 2010 disciplinary order. He did not file the required declaration that he notified his clients, opposing counsel and other interested parties of his suspension. He was suspended and placed on probation for repeatedly engaging in the unauthorized practice of law and committing acts of moral turpitude.In mitigation, he cooperated with the bar’s investigation.May 30, 2010 THOMAS SCOTT SIMONS [#226484], 42, of Mill Valley was suspended for three years, stayed, actually suspended for 90 days and until the State Bar Court grants a motion to terminate the suspension, and he was ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. If the actual suspension exceeds two years, he must prove his rehabilitation. The order took effect May 30, 2010. In a default proceeding, the bar court found that in two matters, Simons repeatedly engaged in the unauthorized practice of law and committed acts of moral turpitude. He was placed on involuntary inactive enrollment in 2005 for not reporting compliance with MCLE requirements and the following year was suspended for not paying bar dues. He was suspended from Sept. 15, 2006, through at least May 5, 2008.While inactive, he handled divorce and family law matters and held himself out as an attorney in both. |
