August 14, 2016

RENE CHAVEZ NUNEZ [#226171], 44, of San Gabriel, was suspended from the practice of law for two years and until he provides proof of his rehabilitation. He was also placed on three years’ probation and faces a three-year suspension if he fails to comply with the terms of his disciplinary probation. He was also ordered to comply with rule 9.20 of the California Rules of Court. The order took effect Aug. 14, 2016.

Nunez stipulated to one count of failing to comply with rule 9.20 as required by an earlier disciplinary order. At the time, Nunez and his wife had been displaced from their home because of a fire. Though he and his wife retrieved the mail every other day, Nunez testified he never saw letters from the Office of Probation reminding him of the Supreme Court order. He also believed he did not have to file a 9.20 declaration because he had no clients.

Nunez had two prior records of discipline. In mitigation, he stipulated to his culpability and was dealing with a house fire.

RENE CHAVEZ NUNEZ [#226171], 42, of San Gabriel was suspended for one year and until he makes restitution and, if he remains suspended for two or more years, shows proof of his rehabilitation. He was also ordered to comply with rule 9.20 of the California Rules of Court. The order took effect May 18, 2014.

Nunez was suspended after his probation was revoked for failing to provide proof that he attended and passed Ethics School and paid restitution. Nunez was suspended in 2012 for failing to provide legal services with competence and failing to refund unearned fees in one client matter.

August 15, 2012

RENE CHAVEZ NUNEZ, 40, of San Gabriel was suspended for one year, stayed, placed on three years of probation and was ordered to make restitution and take the MPRE within one year. The order took effect Aug. 15, 2012.

Nunez stipulated that he failed to perform legal services competently or refund unearned fees while handling a bankruptcy matter. The bankruptcy court threatened to dismiss the case, listing nine deficiencies in Nunez’ filing as well as other missing documentation. It ordered him to correct the filing within 14 days, and although he told the client he would do so, he did not. The case was dismissed.

Although the client complained to the State Bar, it dismissed the complaint after Nunez agreed to file a motion to reopen the case and pay for the cost of the motion. He never did so.

In mitigation, Nunez has no prior discipline record and he cooperated with the bar’s investigation.
