Diaz’s default was entered because he did not file a response to three disciplinary charges filed against him in one client matter. He was disbarred under rule 5.85 of the State Bar Rules of Procedure because he did not move to have the default vacated within 180 days.

The charges were deemed admitted. Diaz violated a court order and failed to perform legal services with competence by not appearing in court for the reading of the verdict in his client’s criminal matter, despite having been repeatedly admonished for excessive tardiness and under explicit court orders that he appear for the verdict reading or arrange for another attorney to make the appearance.
