Discipline Summaries

February 4, 2012

ANTHONY HARRIS [#220714], 52, of San Francisco was suspended for two years, stayed, placed on three years of probation with a six-month actual suspension and he was ordered to take the MPRE within one year and comply with rule 9.20 of the California Rules of Court. The order took effect Feb. 4, 2012.

Harris stipulated to 22 counts of misconduct in seven consolidated matters, including failures to refund unearned fees, respond to client inquiries or perform legal services competently, and he commingled funds, disobeyed court orders and practiced law while suspended for failure to pay bar dues.

In one matter, for example, Harris was hired to file a civil suit against the U.S. Tennis Association but he never did so, nor did he respond to his client’s phone calls or refund any of her $2,500 advance fee. He did not file a complaint or a motion for reconsideration for two other clients, did no work of value for two others and did not pay court-ordered sanctions in two matters.

In mitigation, Harris had no prior discipline record, cooperated with the bar’s investigation, displayed remorse, and had personal difficulties stemming from a divorce and child custody dispute.
