GEORGE HOLLAND, JR. [#216735], 45, of Oakland, was disbarred Sept. 13, 2013 and ordered to comply with rule 9.20 of the California Rules of Court and to pay restitution.

The State Bar Court found that Holland committed acts of moral turpitude, shared fees with non-lawyers, maintained an unjust action, appeared for a party without permission to do so, aided in the unauthorized practice of law and failed to perform legal services with competence, communicate, or to return unearned fees.

The bulk of Holland’s misconduct arose from a foreclosure rescue scheme targeting distressed Filipino-American homeowners. A group run by non-lawyers calling itself American Recourse LLC would hold seminars to find potential clients it referred to Holland for foreclosure rescue/predatory lending litigation service. Holland failed to review clients’ case files or to interview them before frivolous actions were filed on their behalf. The company charged clients monthly fees, which were split between Holland and the non-lawyers.

Holland was found culpable of moral turpitude, sharing fees with non-lawyers, maintaining an unjust action, failing to perform legal services with competence, failing to communicate, appearing without authority, failing to return unearned fees, aiding in the unauthorized practice of law and collecting an illegal fee. Holland also commingled funds in his client trust account, failed to return a client file, failed to report sanctions to the State Bar and failed to obey a court order. He was ordered to pay $34,948.20 plus interest in restitution.

Holland received limited mitigation for having no prior discipline in seven and a half years of practicing law.
