June 30, 2013 JENNIFER F. BLACKBURN [#214781], 39, of Keaau, Hawaii, was disbarred June 30, 2013 and was ordered to comply with rule 9.20 of the California Rules of Court. Blackburn stipulated to violating the terms of a 2011 disciplinary order by not timely filing a declaration stating she had complied with rule 9.20.Blackburn was previously disciplined for not complying with the terms of a 2008 disciplinary order. The 2008 discipline was for eight counts of misconduct in two matters. She failed to perform legal services competently, respond to client inquiries, keep a client informed about developments in his case or refund unearned fees. She also did not cooperate with the bar’s investigation.In mitigation, no clients were harmed as a result of Blackburn’s misconduct, she has shown remorse, she cooperated with the State Bar by entering into a stipulation and showed evidence of her good character. Blackburn received limited mitigation for the fact that she suffers major depression which has contributed to her problems.January 27, 2012 The probation of JENNIFER FAY BLACKBURN [#214781], 38, of Keaau, Hawaii, was revoked and she was suspended for one year, stayed, placed on two years of probation with an actual 90-day suspension and was ordered to comply with rule 9.20 of the California Rules of Court. The order took effect Jan. 27, 2012. Blackburn did not comply with probation conditions attached to an April 2011 discipline. That discipline was imposed because she didn’t comply with probation conditions of a 2008 order as a result of misconduct in two cases. She did not contact the State Bar Probation Office within 30 days or file her first quarterly probation report.In mitigation, Blackburn said the mental and physical stress related to substantial personal and family obligations, including the financial strain of having been laid off in May 2009, led to her failure to timely comply with her probation conditions.April 23, 2011 JENNIFER FAY BLACKBURN [#214781], 37, of Keaau, Hawaii, was suspended for one year, stayed, and placed on two years of probation with an actual 30-day suspension. The order took effect April 23, 2011. Blackburn stipulated that she did not comply with probation conditions attached to a 2008 disciplinary order. She did not meet with a probation officer within 30 days or submit three quarterly probation reports on time or the final report at all. She had stipulated to eight counts of misconduct in two matters. In mitigation, Blackburn was suffering from depression, for which she receives treatment, and had issues related to a move to another state and unemployment.March 22, 2008 JENNIFER FAY BLACKBURN [#214781], 34, of Keaau, Hawaii was suspended for one year, stayed, placed on two years of probation and was ordered to make restitution and take the MPRE within one year. The order took effect March 22, 2008. Blackburn stipulated to eight counts of misconduct in two matters.From 2001 to 2003, she worked for a Fresno law firm. In the course of her work, she was assigned to handle bankruptcy for two women. Although they were domestic partners, they were filing for bankruptcy separately. In 2003, Blackburn left the firm but said she would continue to work on the case in question without further compensation from the clients.However, she did no further work and never filed the bankruptcy petitions.One of her clients was sued for debt owed on a credit card. The client had provided information about that debt to Blackburn, who did not respond to the woman’s messages. The client then went to Central California Legal Services Inc.; one of its attorneys spoke with Blackburn who said she would help the clients with their filings. She did no further work.She stipulated that she failed to perform legal services competently, respond to client inquiries or keep clients informed about developments in their cases.The second matter was also a bankruptcy case for which the client paid a $635 fee. Blackburn told him that she had everything she needed to file the petition. The client called her once a month for more than a year without a response. When he went to her office, it was empty and the fax was disconnected.Blackburn never filed the petition.She stipulated that she failed to perform legal services competently, respond to client inquiries, keep a client informed about developments in his case or refund unearned fees. She also did not cooperate with the bar’s investigation.In mitigation, Blackburn was in the process of moving her family when the clients were trying to contact her, she demonstrated remorse and she cooperated with the bar. |
