October 11, 2015 ARSHAK BARTOUMIAN [#210370], 43, of Glendale, was disbarred Oct. 11, 2015 and ordered to comply with rule 9.20 of the California Rules of Court. The State Bar Court found Bartoumian culpable of 22 counts of misconduct including failing to perform legal services with competence, obey court orders, report sanctions, maintain respect due to the court or to maintain legal or just actions. The misconduct was tied largely to his actions in the U.S. Central District Court of California where he “routinely and repeatedly†filed lawsuits he had no intention of prosecuting. The lawsuits were brought against banks and other institutions under the Fair Debt Collections Practices Act, Fair Credit Reporting Act, or related statutes.“In these virtually identical cases, respondent routinely failed to file a response to defendants’ motions to dismiss, motions for judgment on the pleadings, or other dispositive motions,†State Bar Court Judge Richard A. Patel wrote. “On other occasions, respondent failed to serve defendants, failed to appear at hearings, and failed to comply with the applicable rules of procedure.â€In 49 matters he violated the Rules of Professional Conduct by failing to appear at hearings, file oppositions to motions, prosecute complaints he filed and/or respond to orders to show cause for imposition of sanctions. In eight cases, he failed to obey court orders. In another five, he did not report sanctions of more than $1,000 on nondiscovery-related matters.In mitigation, Bartoumian was suffering from serious health problems and the loss of four family members at the time of his misconduct, entered into an extensive stipulation with the State Bar and presented evidence of his good character. Bartoumian had one prior record of discipline, a May 2013 suspension for failing to obey court orders.June 13, 2013 ARSHAK BARTOUMIAN [#210370], 41, of Glendale, was suspended for one year, stayed, placed on one year of probation and ordered to take the MPRE. The order took effect June 13, 2013. Bartoumian stipulated that he disobeyed court orders in connection with a civil case in which he represented the plaintiffs. Among other things, Bartoumian failed to properly file a substitution of attorney form and then failed to show cause in writing as to why he should not be sanctioned for his error.In mitigation, Bartoumian had no prior discipline and was candid and cooperative during the State Bar’s investigation. |
