JIMMIE DEAN CULP [#208020], 47, of Austin, was suspended from the practice of law for 30 days and ordered to take the MPRE. He was also placed on two years’ probation and faces a one-year suspension if he does not comply with the terms of his disciplinary probation. The order took effect May 29, 2015.

Culp stipulated that in 2011 he failed to file a petition for the removal of a Memorandum of Reprimand and Evaluation Report from his client’s personnel file kept by the U.S. Army. Nonetheless Culp told the client in an email that he’d filed the petition, knowing it was untrue. Over a period of months, the client sent emails asking for an update on the status of his case, but Culp did not respond to them. He also did not promptly release his client’s file or refund unearned fees after the client fired him.

In mitigation, he entered into a pretrial stipulation with the State Bar, had no prior record of discipline, served in the military and was suffering emotional difficulties at the time of his misconduct.
