DANIEL JAMES DeWIT [#], 43, of Santa Ana was suspended for six months, stayed, placed on one year of probation with a 60-day actual suspension and was ordered to take the MPRE within one year. The order took effect Oct. 14, 2011.

DeWit stipulated that he failed to perform legal services competently by failing to supervise a staff member, resulting in a $35,000 fee not being deposited into a trust account as specified in the fee agreement.

A client hired DeWit primarily because of the staffer’s reputation in the deaf community. Over several weeks, the client gave DeWit a total of $35,000 that was to be held in a “special trust account.” However, the staff member deposited the funds in a general account rather than a trust account.

In mitigation, the client was not harmed, DeWit cooperated with the bar’s investigation and he acted in good faith.
