November 28, 2013 MARK D. WALSH [#206059], 44, of San Diego was suspended for one year, stayed, placed on three years’ probation with an actual 30-day suspension and ordered to take the MPRE. The order took effect Nov. 28, 2013. The State Bar Court found that Walsh repeatedly failed to obey court orders in seven collection lawsuits in which he represented the plaintiff creditors. In 2002, Walsh started a statewide debt-collection practice called Legal Recovery Law Offices Inc. In June 2011, he began missing multiple scheduled court hearings and conferences, a problem he later blamed on his computerized case-management and calendaring system and the post office for not delivering all his mail.In mitigation, at the time of his misconduct Walsh had suffered an extremely serious injury that almost led to his death. He also presented testimony from six character witnesses and showed remorse for his wrongdoing.Walsh had one prior record of discipline, a 2008 private reproval for failing to report judicial sanctions. |
