RYAN EMIL DERDOWSKI [#205720], 38, of Sacramento was suspended for one year, stayed, placed on two years of probation and was ordered to take the MPRE within one year. The order took effect Jan. 14, 2010.

Derdowski stipulated that he assisted two non-lawyers in the unauthorized practice of law. His law firm, Gingery, Thompson & Derdowski, employed Justin Gingery’s father and son as administrators and legal assistants. Derdowski did not directly supervise the father and son and was unaware that they held themselves out as lawyers, provided legal advice to clients, negotiated settlements with insurance companies and discussed settlements with clients.

At some point, Derdowski learned that Gingery admitted helping his father in the unauthorized practice of law, although he did not see the stipulation until it was published on the bar’s website. For an eight-month period, the only steps Derdowski and Thompson took to determine whether the father and son were practicing law were to hire an ethics counsel and to draft a letter to be sent to anyone who indicated they thought the pair were lawyers. Derdowski and Thompson failed to take steps to prevent the father and son from engaging in unauthorized practice. At a later time, however, both men took steps to prevent the father and son from doing so.

In mitigation, Derdowski has no prior discipline record, no clients were harmed, he cooperated with the bar’s investigation, demonstrated good character and displayed remorse.
