Jones was disbarred after his default was entered for failing to respond to the notice of disciplinary charges filed against him. Rule 5.85 of the State Bar’s Rules of Procedure allows an attorney to be disbarred if he or she does not seek to have the default set aside with 180 days.The charges were deemed admitted: Jones failed to perform with competence, refund unearned fees, release a file or cooperate in a State Bar investigation. All of the misconduct stemmed from one client matter. Jones was ordered to pay $250 plus interest in restitution. |
