March 26, 2009 VLADISLAV PETER VILTMAN [#203140], 36, of San Francisco was suspended for two years, stayed, placed on four years of probation with an actual 30-day suspension and he was ordered to take the MPRE within one year and prove his rehabilitation. The order took effect March 26, 2009. Viltman stipulated that he commingled personal and client funds in his client trust account and by writing a check against insufficient funds in the account, he committed an act of moral turpitude.Viltman deposited $4,000 in personal funds in his trust account that he used as a “surplus.†He subsequently wrote a check for $3,700 for personal expenses, but did not have enough money in the account to cover the check. Before knowing the check had bounced, he transferred $2,000 from his personal checking account into the trust account, although that amount also did not cover the $3,700 check.In mitigation, Viltman has no prior discipline record, he cooperated with the bar’s investigation and he provided evidence of his good character. |
