SCOTT GARRETT LYON [#199800], 44, of Manteca was suspended for two years, stayed, placed on two years’ probation with a 60-day actual suspension and ordered to take the MPRE. The order took effect April 25, 2014.

Lyon stipulated to misconduct in one client matter, a bankruptcy case he was hired to handle in 2011. Despite the client paying $1,000 in advanced attorney fees and $75 in advanced costs, Lyon ceased communicating with the client, effectively withdrawing from representation. He did not perform any legal services of value on her behalf and did not promptly refund any of the $1,000.

On March 2012, Lyon signed an agreement in lieu of discipline with the State Bar and agreed to comply with certain duties for the next year. Nonetheless, he failed to submit four quarterly reports to probation, did not attend Ethics School within one year of the effective date of the agreement and failed to pay restitution or provide proof of payment to the Office of Probation within six months of the effective date of the agreement.

In mitigation, Lyon had no prior record of discipline and entered into a pretrial stipulation with the State Bar.
