ANITA D. ROSIN [#198496], 46, of Valencia, was disbarred May 10, 2015 and ordered to comply with rule 9.20 of the California Rules of Court and pay restitution.

Rosin was disbarred after her default was entered for failing to appear at trial. Because she did not seek to have the default set aside within 90 days as required under rule 5.85 of the State Bar’s Rules of Procedure, she was disbarred and the charges against her deemed admitted.

Rosin waited nine months to tell three clients she had received settlement checks on their behalf, failed to maintain those funds in her trust account, misappropriated the $13,152.96 in settlement money, failed to promptly pay from the settlement funds their liens for medical expenses, falsely told the clients she had negotiated with their medical providers to have the amount of their liens reduced, failed to inform the clients of significant developments and did not comply with the terms of her disciplinary probation.

Rosin was ordered to pay $12,152.96 plus interest in restitution.

She had one prior record of discipline, a 2009 suspension for failing to maintain client funds in her trust account and committing an act of gross negligence by not ensuring that her client trust account was properly maintained, which resulted in misappropriation of client funds.

ANITA D. ROSIN [#198496], 41, of Rancho Santa Fe was suspended for one year, stayed, placed on two years of probation with a 120-day actual suspension and she was ordered to comply with rule 9.20 of the California Rules of Court and take the MPRE within one year. The order took effect Jan. 14, 2010.

Rosin stipulated that she failed to maintain funds in her client trust account and as a result committed an act of moral turpitude by misappropriating more than $40,000.

She represented a couple injured in an automobile accident, collecting and depositing in her client trust account almost $84,000 from insurance settlements. Rosin was required to maintain at least $44,294 in trust for the clients. She could not distribute any of the settlement funds because there had been no agreement from any providers for reductions in their bills. Although Rosin was aware of her client’s medical bills ($187,306 and $19,650) and engaged in negotiations regarding payment, she did not pay any of the bills.

Rosin’s husband, a software developer, wrote a program to keep track of the bank balance and checks that were issued, and was unaware that individual client balances were not tracked properly. When Rosin learned of a problem with her clients’ account, she didn’t have enough funds to replenish her trust account whose balance had fallen below the required amount.

In mitigation, Rosin believed her accounting system was working properly, she demonstrated her good character and hired an accounting firm to set up new office procedures as soon as she became aware of the problems.
