Discipline Summaries

February 14, 2013

JAMES ALLEN WALL [#197981], 55, of Napa was disbarred Feb. 14, 2013, and was ordered to make restitution and comply with rule 9.20 of the California Rules of Court.

Wall’s default was entered after he failed to appear at trial to answer six counts of misconduct in a single client matter. He had responded to the charges and appeared telephonically at a hearing but did not appear for trial. Because he made no effort to vacate the default within 180 days, as required by rule 5.85 of the bar’s Rules of Procedure, he was disbarred and the charges against him were deemed admitted.

Wall committed moral turpitude by making a misrepresentation to the court, and he failed to perform legal services competently, refund unearned fees, release a client file, obey court orders or report to the State Bar court-ordered sanctions of $2,490.

He was ordered to make restitution totaling $7,490 plus interest.
