CESAR A. LOPEZ [#195868], 47, of Pico Rivera was suspended for two years, stayed, placed on two years’ probation with an actual one-year suspension and ordered to comply with rule 9.20 of the California Rules of Court and make restitution. The order took effect Jan. 30, 2014.

Lopez stipulated that he failed to comply with a number of the terms of his probation arising from a 2011 disciplinary order. Lopez failed to contact the Office of Probation by the deadline, submit five quarterly reports to probation on time, make full restitution to a former client or meet a deadline for providing proof that he attended and passed Ethics School.

Lopez had two prior records of discipline. In 2005, he stipulated to four counts of misconduct in a probate matter: failing to perform legal services competently, respond to a reasonable status inquiries about a case, return unearned fees or release client papers. In 2011, he was disciplined after stipulating to four acts of misconduct in one client matter. He failed to perform legal services competently, communicate significant developments to his client, refund unearned fees or cooperate with a State Bar investigation.

CESAR A. LOPEZ, 45, of Downey was suspended for one year, stayed, placed on two years of probation and was ordered to take the MPRE within one year. The order took effect Aug. 21, 2011.

Lopez stipulated to four counts of misconduct after he substituted into a criminal case after his client, a minor, hired him through his father to complete an appeal and/or prepare a petition for writ of habeas corpus. He received a $4,000 advance fee.

He took no action to substitute in as counsel, did not prepare or file any pleadings on behalf of the client, who remains incarcerated, and did not respond to any client letters.

Lopez stipulated that he failed to perform legal services competently, refund an unearned fee, keep a client informed of significant developments in his case or cooperate with the bar’s investigation.

Lopez was privately reproved in 2005.
