Discipline Summaries

March 29, 2014

MAYRA IVELLISSE LAUREANO [#194702], 48, of Long Beach was disbarred March 29, 2014 and was ordered to comply with rule 9.20 of the California Rules of Court.

Laureano was disbarred after her default was entered when she failed to appear at trial. Because she did not seek to have the default set aside or vacated within 90 days as required by rule 5.85 of the State Bar’s Rules of Procedure, she was disbarred and the charges deemed admitted.

Laureano violated rule 9.20 in connection with a 2012 disciplinary order. She had been disciplined on two prior occasions. In 2011, she was suspended for failing to perform legal services with competence in two matters, promptly return unearned fees or promptly release client papers and property. The following year, she was suspended for appearing in court on a client’s behalf on at least three occasions when she knew that she was enrolled on involuntary inactive status and for failing to perform legal services with competence, render appropriate accounts to a client, refund unearned fees, participate and cooperate in a disciplinary investigation or keep a client reasonably informed of significant developments.

August 11, 2012

MAYRA IVELLISSE LAUREANO, 46, of Santa Ana was suspended for one year, stayed, placed on two years of probation with an actual six-month suspension and she was ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. The order took effect Aug. 11, 2012.

Laureano stipulated to eight acts of misconduct in three matters.

In an unlawful detainer action in which time was of the essence because the client faced eviction, Laureano filed a complaint but did not request a trial date. She also did not respond to her client’s many requests for information. Laureano stipulated that she failed to perform competent legal services, account for or refund her client’s $750 fee and she did not cooperate with the bar’s investigation.

In a civil dispute she handled on a contingency fee basis, she filed a lawsuit but not proof of service and was ordered to show cause. She didn’t appear at two hearings and the case was dismissed. Although she appealed, the appeal was denied, but she didn’t inform her client. Laureano stipulated that she failed to perform legal services competently, inform a client of significant developments in his case or cooperate with the bar’s investigation.

She also practiced law while suspended by making three court appearances in a criminal matter that she took on prior to the suspension. She failed to refund $4,000 in advanced fees.

The suspension was imposed for Laureano’s failures to perform legal services competently, return client files and refund unearned fees in loan modification and breach of contract matters.
