DANIEL SHERVIN KODAM, 39, of Murrieta was disbarred Aug. 17, 2012, and ordered to comply with rule 9.20 of the California Rules of Court.

Kodam stipulated that he committed acts of moral turpitude by fraudulently obtaining $320,000 from a company that purchases from contingency fee lawyers an assignment of their fees on settled cases. In exchange for the purchase, lawyers are able to gain access to a portion of their earned contingency fees on an accelerated basis.

Kodam twice entered into contracts with Modeso LC d/b/a RapidFunds, providing what purported to be fully executed settlement agreements between his clients and the California Department of Forestry. In fact, the signatures on the agreements were forged. Kodam claimed to have earned $232,910.96 in one matter and $164,000 in the other. Modeso wired a total of $320,000, less wire fees, as consideration for the assignments.

After inquiries from Modeso, Kodam admitted the agreements were forgeries and started to make repayments. Modeso sued him and he repaid the $320,000 plus interest.

Kodam enrolled in the State Bar’s Lawyer Assistance Program and is still in therapy, notified his clients and the State Bar of his actions and closed his firm. His attempt to resign from the bar was rejected.

In mitigation, Kodam had no prior discipline record, suffered extreme emotional difficulties and financial problems and he cooperated with the bar’s investigation.
