February 29, 2012 MARK PARDEE McCREDIE [#189962], 53, of Oxnard was suspended for two years, stayed, placed on three years of probation with an actual nine-month suspension and he was ordered to take the MPRE and comply with rule 9.20 of the California Rules of Court. The order took effect Feb. 29, 2012. McCredie stipulated that he failed to comply with probation conditions of a 2008 disciplinary order by filing six quarterly reports late, not filing proof of attendance at four sobriety meetings and filing a proof of authorization for disclosure of drug and alcohol treatment late. In the underlying matter, his probation was revoked. The initial 2006 discipline was imposed after McCredie was convicted of misdemeanor elder abuse and marijuana possession.In mitigation, he cooperated with the bar’s investigation.October 12, 2008 MARK PARDEE McCREDIE [#189962], 58, of Santa Barbara Probation was revoked, the previous stay of suspension was lifted and he was actually suspended for six months and placed on two years of probation. Credit was given for a period of involuntary inactive enrollment that began June 13, 2008. The order took effect Oct. 12, 2008. McCredie was suspended and placed on probation in 2006, but filed six probation reports late, did not provide proof of authorization to release treatment and recovery information to the bar’s probation office or proof that he attended three meetings a month of The Other Bar, as required. In addition, he did not attend ethics school within the prescribed timeframe.The underlying discipline was imposed as a result of two misdemeanor convictions for a crime against an elder or dependent adult and marijuana possession. He also was disciplined for failing to return an unearned $300 fee.McCredie opposed revocation of the probation because his noncompliance resulted from being overwhelmed by the burden of running his law practice alone while meeting the conditions and financial costs of probation. He also argued that he “is less than someone intentionally or willfully ignoring the court’s order.†Although the court rejected those arguments, it also rejected the bar’s request for a one-year suspension as “excessive and not necessary.â€July 13, 2006 MARK PARKEE McCREDIE [#189962], 56, of Ventura was suspended for one year, stayed, placed on three years of probation and was ordered to take the MPRE within one year. The order took effect July 13, 2006. McCredie was convicted in 2000 of misdemeanor elder abuse. Two days later, the police were called to his home and found marijuana in plain view. He was subsequently convicted of misdemeanor possession of marijuana.He stipulated that the convictions did not involve moral turpitude but did warrant discipline.In another matter, a client hired him to handle a wage garnishment for unpaid state taxes and preparation of an injunction to halt the garnishment. After looking into the issues, McCredie concluded that an injunction would not be successful and he told the client he would not prepare it. The client sought a refund of his $300 advance fee, but McCredie did not return any money to him.In mitigation, he was under severe financial stress and had physical or emotional difficulties. |
