CATHERINE ANNE MADSEN [#189917], 36, of St. Paul, Minn., was disbarred April 2, 2003, and ordered to comply with rule 955.

In a default proceeding, the State Bar Court found that Madsen did not comply with rule 955, as required by a 2002 disciplinary order. She did not file the required affidavit with the Supreme Court.

The underlying discipline was imposed as a result of Madsen's failure to appear at a final status conference and at trial, resulting in a default judgment of $290,000 against her clients and the imposition of $4,225 in sanctions against her and her client.

Madsen was disciplined again in 2002 for practicing law while not entitled, misappropriating client funds and making misrepresentations to a client about the release of his share of settlement proceedings.

CATHERINE ANNE MADSEN [#189917], 36, of St. Paul, Minn was suspended for three years, stayed, actually suspended for two years and until she makes restitution, proves her rehabilitation and the State Bar Court grants a motion to terminate the suspension, and was ordered to take the MPRE and comply with rule 955. The order took effect Oct. 27, 2002.

In a default proceeding, the State Bar Court found that Madsen engaged in the unauthorized practice of law, failed to deposit client funds in a client trust account and committed acts of moral turpitude.

Madsen was placed on involuntary inactive status in 2000 after failing to answer a notice of disciplinary charges. Only weeks later, she accepted a personal injury claim, which settled for $3,300. Although she told her client the settlement proceeds would be deposited in her client trust account, she deposited the money in her personal bank account. She also told him the funds had to remain in her trust account until a scheduled arbitration was completed.

The client learned that the medical provider already had been paid and no arbitration was scheduled.

At the time the disciplinary charges were filed, the client had not received any settlement money.

Madsen also was disciplined earlier in 2002 in another default matter. The court found that she failed to competently perform legal services, comply with court orders, report the imposition of sanctions to the State Bar or cooperate with the bar's investigation, and she committed an act of moral turpitude by making a misrepresentation to the court.

February 16, 2002

CATHERINE ANNE MADSEN [189917], 35, of Canyon Country was suspended for two years, stayed, actually suspended for 180 days and until she pays sanctions imposed by the Los Angeles Superior Court, demonstrates her rehabilitation, and complies with conditions of probation, if any, imposed by the State Bar Court as a condition for termination of her actual suspension. She also was ordered to take the MPRE and comply with rule 955. The order took effect Feb. 16, 2002.

In a civil matter, Madsen failed to appear at the final status conference or at the trial. On the trial date, she phoned the court, orally motioning for a continuance and representing that she had been in a car accident 11 days earlier. She also told the court she had filed a motion for summary judgment in the matter.

Her motion to continue was granted, a new trial date was set and Madsen was ordered to produce a letter from her doctor about her medical condition, as well as a copy of the "original filed" stamped motion for summary judgment since neither the court nor the plaintiff's attorney had copies of the motion. She also was ordered to show cause as to why her client's answer should not be stricken for failing to appear at the final status conference and the original trial.

Madsen never filed proof of filing the summary judgment motion, a letter regarding her medical condition or responses to plaintiff's motions. Madsen also failed to appear for trial dates that were set on her motion and the court's own motion, and to show cause. The Superior Court matter concluded with a $290,000 default judgment entered against Madsen's client.

The State Bar Court found that Madsen significantly harmed her client by willfully failing to competently perform legal services and comply with court orders, and by intentionally misrepresenting factual information to the Superior Court. She also failed to cooperate with the bar's investigation or to report judicial sanctions.
